Terms of Service for Recall

1. Use of Recall

Recall is a personal journaling, memory, reflection, and relationship management application designed to help users organise stories, reflections, talking points, and personal interactions.

Recall has a global age rating of 4+ and is suitable for a general audience aged 4 and over. Parents and guardians are responsible for supervising a child’s use of the App.

You agree to use Recall only for lawful purposes and in accordance with these Terms.

You must not:

• use the App in a way that violates laws or regulations
• attempt to interfere with the App's functionality or security
• reverse engineer or attempt to extract source code
• misuse the App in any harmful, abusive, or fraudulent manner

2. Your Content

Recall allows you to create and store personal content including:

• stories and reflections
• notes and memories
• contact details and talking points
• tags, emotions, and templates
• photos you attach to stories or contact profiles
• other personal organisation data you choose to add

You retain ownership of all content you create within Recall.

You are solely responsible for:

• the content you create and store
• ensuring your content complies with applicable laws
• maintaining backups where appropriate

We do not access, monitor, or store your private journal content on servers we operate. Anonymous usage analytics and voluntary feedback are handled separately, as described in our Privacy Policy.

3. Data Storage and iCloud

Your journal content is stored locally on your device and, when iCloud is enabled on your device and Recall is allowed to use iCloud, synchronised within your personal Apple iCloud account using CloudKit.

We do not store your private journal content on servers we operate.

You can turn off iCloud synchronisation for Recall in your device settings without uninstalling the App:

• iPhone or iPad: Settings → [your name] → iCloud → Saved to iCloud → Recall → off
• Mac: System Settings → Apple Account → iCloud → Saved to iCloud → Recall → off

You acknowledge that:

• iCloud services are provided by Apple
• availability of synchronisation features depends on Apple services and your device settings
• data loss may still occur due to device failure, account issues, software bugs, or service interruptions

We are not responsible for:

• loss of data
• failures in iCloud services
• issues arising from your device or account settings

You are responsible for managing your device backups and iCloud account settings.

4. Calendar, Contacts, and Location Permissions

Certain Recall features rely on optional device permissions including:

• calendar access
• contacts access
• notifications
• location services
• photo library access (when you choose to attach photos)

These permissions are optional and can be managed through your device settings.

If permissions are denied, some features may not function fully.

5. Apple Intelligence Features

Recall may integrate with on-device Apple Intelligence capabilities provided by Apple to assist with content suggestions and productivity features.

Availability of these features may vary depending on:

• device compatibility
• operating system version
• region availability
• Apple service availability

We are not responsible for limitations or interruptions related to Apple-provided AI functionality.

6. Anonymous Usage Analytics

Recall may collect anonymous usage information to understand how features are used and to improve the App. This does not include the content of your stories, notes, contact details, calendar events, search queries, photos, or other personally identifying information.

You can disable anonymous usage analytics at any time in Settings → Share Anonymous Analytics. Further details are set out in our Privacy Policy.

7. Feedback and Support

You may optionally submit in-app feedback or contact us by email for support. By submitting feedback or support requests, you agree not to include sensitive personal information unless you choose to do so voluntarily.

We may use feedback and support communications to investigate issues, improve Recall, and respond to enquiries. We do not use them for advertising or sell them to third parties. See our Privacy Policy for more information.

8. Subscriptions and Purchases

Recall may offer optional paid features through Recall Premium subscriptions or one-time purchases available via the Apple App Store.

You acknowledge that:

• payment processing is handled by Apple; we do not receive your payment card or bank account details
• subscriptions, where offered, renew automatically unless cancelled in your Apple ID settings
• refunds and billing disputes are handled according to Apple's App Store policies
• prices, trial offers, and available plans may change from time to time

You can manage or cancel subscriptions in your Apple ID account settings on your device.

9. Privacy

Your use of Recall is also governed by our Privacy Policy, which explains how we handle information, including anonymous usage analytics, feedback, diagnostics, and Apple services.

In the event of any conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy prevails.

10. Apple Services

Recall relies on Apple services including:

• iCloud / CloudKit— synchronisation of your private journal data, and storage of anonymous usage analytics and voluntary feedback
• MetricKit— app performance diagnostics on iOS
• App Store / StoreKit— distribution and in-app purchases

These services are governed by Apple's own terms and privacy policies. We do not use third-party analytics, advertising, or crash-reporting services.

These Terms are between you and Midnytt Origin, not with Apple. Apple is not responsible for the App or its content, maintenance, support, or legal claims relating to the App.

11. Disclaimer

Recall is provided on an “as is” and “as available” basis.

We do not guarantee that:

• the App will always be available
• the App will always function without errors
• features will remain permanently available
• data loss will never occur

12. Limitation of Liability

To the maximum extent permitted by law, Midnytt Origin is not liable for indirect, incidental, consequential, or special damages arising from your use of Recall, including loss of data, device issues, interruptions, or service failures.

Nothing in these Terms excludes rights that cannot be excluded under applicable consumer protection laws.

13. Changes to Recall

We may update, modify, suspend, or discontinue features of Recall at any time.

14. Termination

We may suspend or terminate access to Recall if necessary, including where these Terms are violated or where required for operational, legal, or security reasons.

15. Changes to These Terms

We may update these Terms from time to time.

Continued use of Recall after updates means you accept the revised Terms. Updated versions will include a revised Effective Date.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia.
